Companies must comply with a series of requirements and obligations that both the company and the workers must comply with during their transfer. The Spanish Government recently approved a European directive that has been transposed into the Spanish one on the posting of European workers to Spain. This regulation regulates the recognition and assistance of workers within the Union , executing and assessing the possible economic and administrative sanctions in the case of non-compliance in displacements.

What obligations must foreign companies in Spain and Spanish companies that displace a worker within the European Economic Area? The registration of the data, communicating the details of the transfer, must be carried out within a period of six months.



The communication with the information of the employee transferred or coming from a European country must have the identification and contact information of: A representative of the company in Spain or abroad, who in turn must serve as a liaison with the Spanish authorities to carry out all the document management. A representative of the company in Spain or abroad for all the procedures in which information and consultations on posted workers are provided.
